These Terms of Service ("Terms") govern your use of the POPWIZ platform and services operated by CONFLUX LABS LTD, a company registered in England and Wales (registered at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ). By accessing or using our service, you agree to be bound by these Terms.

1. Service Description

POPWIZ is a digital software-as-a-service (SaaS) platform that provides AI-powered commercial photography tools. Our service includes:

Self-Serve Platform: Users can independently create AI-generated commercial photography using our platform tools, templates, and AI models.

Bespoke Generation Service: Our team creates custom AI-generated imagery tailored to your specific creative brief and brand requirements.

2. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating an account and keep it up to date. You must be at least 18 years old to use our service.

3. Intellectual Property

Your Content: You retain all rights to the images and materials you upload to our platform. By uploading content, you grant us a limited licence to process it solely for the purpose of delivering the requested service.

Generated Content: AI-generated images created through our platform are licensed to you for commercial use under your active subscription. Upon cancellation, previously generated and downloaded content remains yours to use.

Our Platform: The POPWIZ platform, including its design, features, and underlying technology, remains the intellectual property of CONFLUX LABS LTD.

4. Subscription & Billing

POPWIZ uses a credit-based billing system:

  • Subscription Credits: Allocated monthly, reset at end of each billing cycle, do not carry over. Upon cancellation, remaining credits are usable until the current period ends.
  • Credit Packs: One-time purchases valid for 1 year from purchase date. Purchasing a new pack extends the validity of all existing pack balances.
  • Deduction Order: Subscription credits are used first, followed by pack credits.
  • Welcome Bonus: New users receive 3 free credits (treated as pack credits, 1-year validity).

Payment is processed securely through Stripe in USD. Subscriptions renew automatically each month. Prices are subject to change with 30 days' prior notice.

Payment Methods: Subscriptions accept credit cards only. Credit packs accept credit cards, Alipay, and WeChat Pay.

5. Cancellation Policy

You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing cycle — you will continue to have access to the service until that date. No partial refunds are issued for unused time within a billing period.

6. Refund Policy

Due to the nature of digital services and the high computational costs associated with AI generation:

  • No refunds are provided for the current billing period once the service has been accessed or AI generations have been performed.
  • Billing errors: If you believe there has been a billing error, please contact [email protected] within 7 days of the charge. We will investigate and issue a correction or refund if warranted.
  • Service issues: If the platform experiences significant downtime or technical failures that prevent you from using the service, we may at our discretion offer account credit or a pro-rata refund for the affected period.
  • Failed generations: If an AI generation fails to return a valid result due to technical reasons, the credits consumed will be automatically refunded.

7. Acceptable Use

You agree not to use our service to: generate illegal, harmful, or offensive content; infringe upon the intellectual property rights of others; attempt to reverse-engineer, copy, or extract our AI models; resell or redistribute platform access; overload or disrupt our infrastructure.

We reserve the right to suspend or terminate accounts that violate these terms.

8. AI-Generated Content Disclaimer

All content generated through this platform is AI-synthesised. AI-generated results may not perfectly match expectations. We make no warranty regarding the accuracy, completeness, or fitness for purpose of generated content.

9. Limitation of Liability

To the maximum extent permitted by applicable law, CONFLUX LABS LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice on our platform at least 30 days in advance. Continued use of the service after changes take effect constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
